The Revised Uniform Adoption Act provides the right to counsel for a parent who consents to the adoption of a minor during all stages of the proceeding to terminate the parent- child relationship if the minor is to be placed for adoption by a child-placing agency. N.D. Cent. Code § 14-15-19.1 (2005). Prior to the termination proceedings, the court shall inform the parent of the right to counsel provided by this section. Id. Furthermore, if indigent, the court shall order (upon the parent's request) that a state's attorney serve as free legal counsel to the parent. Id.
If "yes", the established right to counsel or discretionary appointment of counsel is limited in some way, including any of: the only authority is a lower/intermediate court decision or a city council, not a high court or state legislature; there has been a subsequent case that has cast doubt; a statute is ambiguous; or the right or discretionary appointment is not for all types of individuals or proceedings within that category.
