Legislation (dead): civil forfeiture

01/03/2017, Legislation, Forfeiture (incomplete)

SB 8 would have required a criminal conviction prior to forfeiture, and where the defendant is represented by the Public Defender in criminal proceeding, it would have authorized the PD's office to represent the individual in the forfeiture proceeding.  The Committee on Corrections and Criminal Law recommended passage of a substitute, which passed the Senate, but the bill died in the House Committee on Courts and Criminal Code.
